The Temporary Skill Shortage (TSS) Subclass 482 visa is one of the most commonly used visas for employers in Australia to sponsor skilled overseas workers. This visa replaced the former 457 visa and helps businesses address shortages in the local labor market by bringing in skilled workers from overseas.
Key Features:
- Duration and Occupational Lists:
- Medium and Long-Term Strategic Skills List (MLTSSL) or Regional Occupation List (ROL): Visa can be granted for up to four years, with the potential for renewal onshore for another four years, and a pathway to permanent residency after 2–3 years.
- Short-Term Skilled Occupation List (STSOL): Visa can be granted for up to two years, with the option to renew for another two years. Hong Kong passport holders may be granted a visa for up to five years.
- Purpose: The TSS visa is designed to assist businesses facing difficulties in finding skilled labor within the local market.
- Labour Agreements: If the occupation you wish to sponsor is not listed on the Skilled Occupation Lists, you may consider entering into a Labour Agreement with the Department of Home Affairs.
Main Requirements of the Subclass 482 Visa:
- Labour Market Testing (LMT):
- Employers must demonstrate that they have tested the local labor market by advertising the position, unless exemptions apply. This must be done within the four months before lodging the nomination application.
- If an Australian citizen or permanent resident was made redundant from the nominated occupation within the four months prior to lodging, advertising must have occurred from the redundancy date.
- English Language Requirements:
- Short-Term Stream: IELTS score of at least 4.5 in each test component (or equivalent in PTE, TOEFL, etc.).
- Medium-Term Stream: IELTS score of at least 5.0 in each test component (or equivalent in PTE, TOEFL, etc.).
- Exemptions apply for passport holders from certain English-speaking countries, those with five years of full-time study in English, or for those earning a guaranteed annual salary of at least AUD 96,400.
- Work Experience:
- Applicants must have at least two years of work experience in the nominated occupation or a related field. Relevant industry placements, internships, or apprenticeships may also be counted, provided they align with the skill level of the nominated occupation.
